CLIENTS ARE HIGHLY ADVISED TO READ M.I.A'S TERMS OF SERVICE BELOW All clients must complete a health intake form before service. The Therapist & Client's responsibility is to arrive early for the intake form to be filled out in full & start on time. 20-30 minutes must be available for the first visit to have a proper Body Assessment to better asset the client. Some health conditions may prevent you from receiving a massage. You may be required to have written permission from your primary health physician before service. If you are not sure if Massage Therapy is safe for your condition, it is your responsibility to check with your health physician before making your appointment. All information collected from the intake form and any discussions during treatment will be confidential and never shared with third parties without written permission from the client. Clients under the age of 18 (eighteen) have to have signed parental consent & parent present. Certificate or Voucher etc. must be presented & brought to the attention at the time of booking to the receptionist over the phone. Gratuity is not included in the total price. ***Rule Of Thumb: tips are not added into the total amount price. 15–20% tip is appropriate. And remember: if the massage is discounted, you should tip 15–20% of the full price, not the discounted price, depending on how satisfied you are with the Elite Services. Please let us know at all if anything could be improved. There is a 8% Tax Rate on the total price at the time of checkout that is for tax purposes for filing at the end of the year. All massage treatments are for therapeutic purposes only. Any inappropriate behavior (drug use, excessive drinking, illicit or sexually suggestive remarks or sexual advances) will result in immediate termination of the massage session, and the client will be a charge for the full price of the booked service. **If Red Flags are brought to our Therapists attention as well as the M.I.A business owner's attention through our SOAP NOTES database and our close Networking in all the surrounding cities, we exercise our right to refuse service & cancel an appointment at any time before a service begins. Suppose our Specialists feel uncomfortable because of a safety compromise; they are not required to keep the appointment. Our Elite Relaxation Specialists are ONLY serviced for the intention of Relaxation & Pain Relief. M.I.A does not under any circumstance participate in any inappropriate or sexual behavior. It is a protocol that we write and report to the business owners in the case of slander. We are a respectable business here in Canton, Texas, and plan to keep it that way. In case of inclement weather or sudden illness, therapist will give notice as soon as possible! By scheduling your massage, you indicate that you understand and accept these terms and conditions & will abide by them at all times. Scheduling Policy We hold payment information as part of our cancellation policies and only make necessary changes to your account on your scheduled service date. Details of our cancellation policy are provided below. A Visa, MasterCard, Discover, or American Express credit card is required to hold your appointment(s). We observe strict privacy policies and will not disclose this information to any other party. Your credit card number will be securely kept in your history file. Prices and services are subject to change without notice. We will do our best to keep our clients up to date on any changes that may occur but encourage all clients to inquire about pricing and available services when booking your appointment. Cell Phones Policy We kindly ask that you turn your cell phones and pagers to vibrate upon arrival. Please inform your therapist should you need to make a phone call so that you may do so without disturbing your scheduled treatment abruptly, which could, in turn, very much affect your treatment as well as affecting the length of your services. Cancellation Policy and Fees STRICT AND ENFORCED 24 HOUR CANCELLATION POLICY! Should you need to cancel, please do so at least 24 hours in advance of your scheduled appointment. If you cancel with less than 24 hours’ notice, your credit card on file will be charged the cancellation fee. Suppose you do not arrive at your scheduled appointment without providing notification. In that case, the service will be considered rendered, and you will either be charged the full amount of the service or the cancellation fee. Should you arrive late for a scheduled appointment and time does not allow us to perform some or all of your treatment, the full amount of the service or the cancellation fee will be charged to your credit card on file. The cancellation fee for ALL Services is 50% of the scheduled service amount. Please be aware that your spa treatments are reserved especially for you. We value your business and ask that you respect all of M.I.A's policies. Should you need to cancel or reschedule, please notify us at least 24 hours in advance. Any cancellations with less than 24 hours of notice are subject to a cancellation fee amounting to the scheduled service's cost or half the prices of the total amount of the service scheduled. We recognize the time of our clients and staff is valuable and has implemented this policy for this reason. When you miss an appointment with us, we lose not only your business but also the potential business of other clients who could have scheduled an appointment for the same time. Additionally, our staff will often be functioning in an "on call" status on-call have traveled to the spa specifically for your service. For these reasons, we are obligated to compensate our staff for their time and make up for the lost revenue. When you schedule your appointment with us, you agree to these policies. All services require a credit card or gift certificate to guarantee a reservation so, please have your credit card and/or gift certificate ready when booking. You will not be billed unless there is a cancellation or no show. Upon checkout, guests may choose their method of payment. We understand that sometimes schedules adjustments are necessary; therefore, we respectfully request at least 24 hours notice for cancellations. CANCELLATION FOR OUR PREFERRED GUESTS POLICY If you are a Loyal Preferred Guest of M.I.A and need to cancel within a 24 hour period, your cancellation fee may be waived at the discretion of your Service Provider. Appointment Reminder Policy As a courtesy to our clients, our system automatically e-mails an or text and or call appointment reminders 48 and or 24 and or 1 hour(s) before the scheduled service. If you choose not to provide us with your e-mail address, we cannot offer you a reminder. Should the appointment reminder system fail for any reason, and you do not receive an appointment reminder, it is still your responsibility to manage your appointment and adhere to the cancellation policy. Check-in Policy We ask that you please arrive 10-15 minutes prior to your appointment time so that there is enough time for you to comfortably fill out and complete the Client Intake Form that is required. There are also options available on our scheduling website here that allows you to fill out your full Client Intake Form online once you choose services & schedule. We will do our best to accommodate late arrivals. However, the length of service may be adjusted so as not to interrupt the scheduled appointments of other guests. The full price of scheduled services will apply, so please plan accordingly. Of course, beyond the check-in policies, we invite all our guests receiving services to make full use of our Elite relaxing environment here at M.I.A so come early, stay late, bring a book, relax and enjoy a cup of complimentary wine or water as well as extra seasonal treats we may have. Please leave all jewelry and valuable items at home. M.I.A or our Elite Relaxation Specialists are not responsible for lost or misplaced items. Gift Certificate Policy Gift Certificates are available in any amount and may be purchased online or by phone at 903-830-7838. Out of town? Too busy? No problem. We will mail your gift certificate to you. Unfortunately, we cannot process any returns or reimburse any payment transactions on gift certificates even if lost, misplaced, or stolen. Gift certificates cannot be redeemed as cash or store credit. Gift Certificates must be mentioned when making your appointment. Series of Treatments Policy We cannot process any returns or reimburse any payment transaction on any spa treatment series purchased. We will, however, exchange them for other products or spa credit of equal value. Gratuity Policy Gratuity is not included in the price of service or spa packages; customary tipping runs 20% to 25% and up but is, of course, at your discretion. You may tip the therapist in the room or check out at the front desk with cash, check, or credit card. Spa Promotions Policy Spa specials cannot be used in combination with any other offer, promotions, or third party gift certificates. Return Policy Unfortunately, we do not do any cash refunds once services are purchased. We will exchange the amount as store credit of equal value to use at any time, depending on the circumstances. CONFIRMATION CALLS and or TEXT Policy As a courtesy, we will call and or text and confirm your service appointments two business days before your appointment date. Parking Policy Remember to rest and drink water before and after any massage or service. Inclement Weather Policy M.I.A standard policy is that appointments canceled with less than 24-hours notice incur a cancellation fee. During the winter months, we are willing to make an exception to that rule. Suppose the area is under a winter weather advisory, and you believe that it would be unsafe or impossible for you to travel to your appointment. In that case, you may reschedule within the 24-hour window at no charge. Health Conditions Policy Please advise us when booking any health conditions, allergies, injuries, recent surgeries, pregnancy, or special needs, which may affect your services. Modesty Concerns Policy It is never required that you are unclothed in front of anyone at M.I.A. Towels and robes are provided and can keep you covered. Therapists are well trained in the “art of draping,” which means that they leave the treatment room while you get under the sheet on the massage table, and they keep you covered at all times except for the area of the body they are massaging. They also leave the treatment room before you get up from the table. If you have a treatment for the first time, feel free to ask the receptionist or therapist how you should be dressed for treatment. We want to make sure that you are comfortable, so please let us know if you have any questions. There is a white button on the side of the Elite Relaxation Table when facing down that is pressed when you are ready for the therapist to return in the room once you on on the table explained before the therapist leaves. Customers must provide "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" with a valid credit or debit card (Visa, MasterCard, or any other accepted issuer) or use any other payment or financial mechanism specified by "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" (“Payment Provider”) as a condition to making any payments. Therapists must support the use of the Payment Providers and provide "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" with valid bank account information (e.g. account and routing number) as a condition to receiving any payments. The Customer’s Payment Provider agreement governs its use of the designated credit or debit card or another mechanism, and the Customer should refer to that agreement and not this agreement to determine its rights and liabilities. By providing "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" with your payment and/or financial information, you agree that "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" and any of its third-party payment processors are authorized to immediately debit or credit your account for all applicable fees and charges and that no additional notice or consent is required. You agree to immediately notify "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" of any change in your payment and financial information. "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" reserves the right at any time to change its prices and billing methods. All information you provide to us or our third-party payment processors must be accurate, current, and complete. You will also be responsible for paying any applicable taxes relating to payments that you make or receive. 7.5.Cancellations and Rescheduling. If you are a Therapist or Customer, you agree to "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A"’s cancellation and rescheduling policy and the associated charges and payments, the terms of which are located here RATES & and are incorporated herein by reference. 8.7.Feedback. If you submit any ideas, suggestions or testimonials “Feedback” to "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A", you hereby transfer to us all rights in such Feedback without charge. You also agree that "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" shall have the right to use and fully exploit such Feedback in any manner that we consider appropriate, including posting on the Internet. Please note that the Feedback you provide to us will not be treated as confidential information – accordingly, you agree not to submit to us any information or ideas that you consider to be confidential or proprietary. You may only submit images and material if you have obtained appropriate copyright and other permission to submit such materials and to permit "Nina Raisa Naomi Tarpley 'LMT' FOUNDER OF M.I.A" to use such material without restriction. You agree that you will not violate or infringe the rights of third parties, including privacy, publicity, and intellectual and proprietary rights, such as copyright or trademark rights. 9Our Responsibility for Loss or Damage TO INDIVIDUAL CUSTOMERS THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LEGAL WARRANTIES, CONDITIONS, LIABILITY OR CERTAIN DAMAGES OR LIMITATIONS OF REPRESENTATIONS MADE CONCERNING GOODS OR SERVICES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. 9.1.DISCLAIMER. THE SERVICES ARE PROVIDED “AS IS.” YOU AGREE TO USE THE SERVICES SOLELY AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR USE OF THE SERVICES. ALTHOUGH WE INTEND TO TAKE REASONABLE STEPS TO PREVENT ANY DAMAGES TO YOU, WE ARE NOT LIABLE FOR ANY DAMAGES OR HARM ATTRIBUTABLE TO THE FOREGOING. ANY REPRESENTATIONS MADE TO YOU BY ANY THERAPIST(S) ARE MADE SOLELY AT THE DISCRETION OF THE THERAPIST AND M.I.A HAS NO WAY TO MONITOR OR VALIDATE, AND SHALL NOT BE RESPONSIBLE OR LIABLE IN ANY WAY FOR, ANY REPRESENTATIONS OR STATEMENTS MADE TO YOU BY THE THERAPIST(S). YOU UNDERSTAND AND ACKNOWLEDGE THAT M.I.A SHALL HAVE NO LIABILITY TO YOU FOR ANY STATEMENTS OR REPRESENTATIONS MADE BY THE THERAPIST TO YOU AS A RESULT OF YOUR USE OF THE SERVICE(S). 9.2.THE SITE IS NOT BESPOKE TO YOU. YOU ACKNOWLEDGE THAT THE SITE HAS NOT BEEN DEVELOPED TO MEET YOUR INDIVIDUAL REQUIREMENTS, AND THAT IT IS THEREFORE YOUR RESPONSIBILITY TO ENSURE THAT THE FACILITIES AND FUNCTIONS OF THE SITE MEET YOUR REQUIREMENTS. 9.3.WE ARE RESPONSIBLE TO YOU ONLY FOR FORESEEABLE LOSS AND DAMAGE CAUSED BY US. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. 12.5.Rights and Remedies. Unless stated otherwise, all remedies provided for in this agreement shall be cumulative and in addition to and not in lieu of any other remedies available to either party at law, in equity, or otherwise.
